Make Local Terms of Service

Welcome to Make Local (the "Service"), operated by CODE THE CODE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, a legal entity registered in Poland (referred to as "Make Local", "we", "us", or "our"). By accessing or using our website located at makelocal.eu, you agree to comply with and be bound by these Terms of Service (the "Terms"). Please review these Terms carefully. If you do not agree to these Terms, you may not use the Service.

1. The Service

Make Local operates as an online marketplace facilitating connections between individuals and small businesses who own 3D printers ("Makers") and users seeking 3D printed items ("Customers"). The Service aims to process payments and handle disputes between users. Make Local connects users, processes payments, and handles disputes. While we will do our best to facilitate positive interactions, we cannot take any responsibility to solve all issues, nor do we provide any guarantees regarding the outcome of orders or interactions.

Please note that for now, these terms do not explicitly cover defense/emergency/NGO/government parts, although the underlying platform is designed with dual-use capability in mind.

2. User Accounts and Roles

To use the Service, you must register for an account. You will be required to specify your user role, either as a Maker or a Customer.

  • Customers place orders and provide or select 3D models.
  • Makers list information about their production units (3D printers), including location, capabilities, and compatible materials.

We will collect user data, including email and address for delivery.

3. Ordering and Production Process

Customers place orders by providing a 3D model or selecting from available models on the platform, specifying details like quantity and material. Makers list details about their printers and available production units.

A fitting algorithm will be used to match orders to suitable Makers based on criteria such as material and printing technology. The algorithm is private and subject to change.

Customers' 3D models will be accessible to Makers who are associated with potential orders.

If an order cannot be immediately matched with a free production unit meeting the specified requirements, it will be placed in a queue. Makers can manually select orders from this queue if they remain unpicked for too long and send custom offers, including price and messages (e.g., if a special material is needed).

4. Pricing and Payment

The Service will suggest a price for orders. Makers can accept the suggested price, propose an alternative price, or suggest other changes to an order. The Customer must then accept or decline any such proposals.

Make Local will take a 5% commission from transactions processed through the Service.

Payments will be processed through third-party services. The payment is transferred from the Customer to the Maker after a delay, provided the Customer does not initiate a dispute. In case of a dispute, the payment for the order will be frozen until the dispute is resolved. The vendor for payment processing has not yet been finally chosen.

5. Disputes and Quality

Make Local will handle disputes that arise between users. As noted above, payment for the relevant order will be frozen during a dispute.

The Service provides information about users' interaction history. Reputation is intended to serve as a mechanism to deter bad behavior, similar to freelance platforms.

Quality checks are explicitly stated as not the responsibility of the Service. However, the possibility of introducing additional roles for quality checks in the future is mentioned.

6. Intellectual Property (IP)

Users are permitted to publish their 3D models and other intellectual property objects on the platform. Users can specify a license of their choice for their IP. Users can set access levels for their IP, including public, private, and shared with specific users. Models can be free or paid.

Make Local does not take responsibility if users share their intellectual property with others.

Users can file requests claiming that a model or other content on the platform infringes on their intellectual property rights.

7. Use of AI

An AI service will be provided to assist Customers with aspects like selecting models, materials, technologies, and other order details. Please be aware that this AI can make mistakes, and we need to cover this possibility.

8. Third-Party Services

Please note that aspects of the Service rely on third-party services. This includes:

  • Processing payments between users.
  • Handling the delivery of finished parts.
  • Providing AI assistance to Customers.

User requests, in the form of orders, are processed and matched within the Make Local platform, but the fulfillment relies on these third-party integrations.

9. Content and Account Moderation

The Service reserves the right to delete models or temporarily or permanently block accounts. Such actions can be taken in cases of illegal activities or any activity deemed by us to cause damage to the Service, our users, or third parties. The final decision regarding moderation rests with Make Local, and we do not take any obligation to provide an explanation for such actions.

10. Community Features

Users will have access to chat functionality, particularly for communication related to orders. Information about orders and production units will be shared publicly to visualize supply and demand on a map.

11. Jurisdiction and Governing Law

The Service's jurisdiction will be the EU. For now, these Terms and any disputes arising from them will be governed by and construed in accordance with Polish laws.

12. Legal Entity

The current legal entity operating the Service is CODE THE CODE SPÓŁKA Z O O, registered in Poland.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Service.
